La DRAAF \/ SRFD souhaitait pr\u00e9senter les r\u00e9sultats 2023 de l\u2019observatoire sur les conditions de recrutement et d\u2019emploi des ACB. Mais pour l\u2019\u00c9lan commun cette r\u00e9union devait aussi permettre un premier bilan r\u00e9gional des directives nationales et des discussions engag\u00e9es localement concernant le protocole.<\/b><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\"><b>1 &#8211; <u>O<\/u><u>bservatoire sur les conditions de recrutement et d\u2019emploi des ACB<\/u><\/b><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">Cet observatoire a \u00e9t\u00e9 cr\u00e9\u00e9 en 2022 \u00e0 la demande de la DGER qui souhaitait disposer d\u2019informations sur les conditions de travail des agents des CFA et CFPPA, en lien avec la performance des centres. Elle souhaitait \u00e9galement obtenir un \u00e9tat des lieux du dialogue social. Les indicateurs de performances ont \u00e9t\u00e9 arr\u00eat\u00e9s par le CGAAER.<\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">La DRAAF se dit satisfaite du taux de r\u00e9ponse \u00e0 l\u2019enqu\u00eate 2023 en Nouvelle-Aquitaine (91% soit 31 centres sur 34). Selon elle, il ressort de cette enqu\u00eate un faible \u00e9cart de r\u00e9sultat entre la Nouvelle-Aquitaine et l&rsquo;ensemble du territoire fran\u00e7ais sur de nombreux items. <\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">En ce qui concerne les domaines o\u00f9 il y a peu de diff\u00e9rences, elle souligne\u00a0:<\/span><\/span><\/span><\/p>\n<ul>\n<li>\n<p align=\"justify\"><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">un nombre de semaines d&rsquo;ouverture des centres en moyenne quasi \u00e9gal au national\u00a0: 45,8\/an,<\/span><\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<ul>\n<li>\n<p align=\"justify\"><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">un certain nombre de centres ont un fonds de roulement proche de la moyenne nationale.<\/span><\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<p align=\"justify\"><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">Mais on note aussi des diff\u00e9rences entre la Nouvelle-Aquitaine et le national\u00a0:<\/span><\/span><\/span><\/p>\n<ul>\n<li>\n<p align=\"justify\"><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">davantage de centres compos\u00e9 de multi sites en Nouvelle Aquitaine,<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">une plus forte proportion de PNA (4,7% en Nouvelle Aquitaine contre 3% au niveau national), ce qui serait p\u00e9nalisants pour les EPL selon la DRAAF, <\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">un nombre de vacataires inf\u00e9rieur au national,<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">un nombre de travailleurs en situation de handicap inf\u00e9rieur au national,<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">si les CDD peuvent durer 6 ans maxi, on est sur une moyenne de 4,7 ans ce qui sous-entend que les centres n&rsquo;attendent pas les 6 ans pour Cdis\u00e9<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">40% des agents sont en CDD<\/span><\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<p align=\"justify\"><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">L\u2019\u00c9lan commun d\u00e9nonce l\u2019utilisation du terme p\u00e9nalisant lorsque le SRFD \u00e9voque la pr\u00e9sence des personnels en PNA dans les centres. Il rappelle au contraire que ces personnels sont une richesse pour les centres.<\/span><\/span><\/span><\/p>\n<p align=\"left\"><span style=\"font-family: Arial, sans-serif\">L\u2019\u00c9lan commun d\u00e9nonce un taux de CDD sup\u00e9rieur \u00e0 40\u00a0% qui entra\u00eene obligatoirement des probl\u00e8mes notamment de turn-over dans les \u00e9tablissements.<\/span><\/p>\n<p align=\"justify\"><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">De m\u00eame l\u2019\u00c9lan commun regrette que cette enqu\u00eate ne permette pas d&rsquo;exploiter les donn\u00e9es sur le temps de travail ou sur les r\u00e9mun\u00e9rations faute d\u2019une comptabilisation identique sur tous les EPL.<\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\"><b>2 \u2013 <u>Mise en place du nouveau cadre local<\/u><\/b><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">L\u2019\u00c9lan commun se bat depuis de nombreuses ann\u00e9es pour l\u2019am\u00e9lioration des conditions de travail des agent.es contractuel.les sur budget dans les CFAA et les CFPPA. Apr\u00e8s l\u2019intensification des mobilisations des personnels de ces derniers mois, ce combat a port\u00e9 ses fruits avec la sortie de la note de service du 8 juillet 2024 qui impose \u00e0 chaque EPLEFPA de mettre en \u0153uvre des conditions d\u2019emploi des ACB conforment \u00e0 la trame nationale. Ce nouveau cadre local devra \u00eatre soumis au conseil d\u2019administration avant le 30 juin 2025. <\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">Pour l\u2019\u00e9laboration de ce nouveau cadre d\u2019emploi local (auparavant nomm\u00e9 protocole d\u2019accord local) construit sur la base de la note de service chaque EPL devra mettre en place des groupes de travail pour observer les situations locales et adapter les protocoles existants au cadre national. Ils devront veiller \u00e0 maintenir les conditions les plus favorables pouvant pr\u00e9exister.<\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">C\u2019est donc dans ce contexte que se r\u00e9unissait la commission r\u00e9gionale et c\u2019est la raison pour laquelle l\u2019\u00c9lan commun attendait un premier bilan des groupes de travail en Nouvelle Aquitaine.<\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">Selon la DRAAF, \u00e0 ce stade, sur 22 EPLEFPA en Nouvelle Aquitaine, 12 n\u2019ont pas commenc\u00e9 le dialogue social au travers des groupes de travail pourtant pr\u00e9vus par la note de service du 8 juillet. <\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">Si le SRFD pr\u00e9cise que chaque EPL a son autonomie et qu\u2019il ne prend pas position sur ce sujet, pour l\u2019\u00c9lan commun un tel r\u00e9sultat est inacceptable et laisse pr\u00e9sager un travail b\u00e2cler dans les EPL qui n\u2019ont rien entam\u00e9. Il demande donc que d\u00e8s la rentr\u00e9e de janvier chacun de ces EPL soit rappel\u00e9 \u00e0 l\u2019ordre. <\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"color: #000000\"><b><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">3 \u2013 <\/span><\/span><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\"><u>M\u00e9decine du travail dans les CFA \/ CFPPA<\/u><\/span><\/span><\/b><\/span><\/p>\n<p align=\"justify\"><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">L\u2019\u00c9lan commun interroge \u00e9galement la DRAAF \/ SRFD sur <\/span><\/span><\/span><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">la m\u00e9decine du travail<\/span><\/span><\/span><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\"> pour les agents des CFA et CFPPA. <\/span><\/span><\/span><strong><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">Aujourd&rsquo;hui <\/span><\/span><\/span><\/strong><strong><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">beaucoup de centres <\/span><\/span><\/span><\/strong><strong><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">ne r\u00e9pondent pas \u00e0 leur obligation <\/span><\/span><\/span><\/strong><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">de proposer aux agents des visites m\u00e9dicales p\u00e9riodiques dans le cadre du travail. De m\u00eame ils ne r\u00e9pondent pas non plus \u00e0 l&rsquo;obligation des visites m\u00e9dicales de reprise dans le cas de certains arr\u00eats de travail. Ils sont en d\u00e9faut vis \u00e0 vis de la loi. La m\u00e9decine du travail est un droit des salari\u00e9.es et une obligation \u00e0 la charge de l&#8217;employeur.<\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">Les personnels ACB des CFA et CFPPA ont les m\u00eames droits que les agents des lyc\u00e9es.<\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">Certains \u00e9tablissements ont sign\u00e9 des conventions avec des organismes ext\u00e9rieurs sp\u00e9cialis\u00e9s dans le suivi m\u00e9dical du travail.<\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">L\u2019\u00c9lan commun demande que la DRAAF relance tous les EPL sur l\u2019obligation d\u2019une m\u00e9decine de pr\u00e9vention pour tous les agents et demande qu\u2019une enqu\u00eate soit r\u00e9alis\u00e9e aupr\u00e8s des centres pour savoir ce qui est mis en place et qui fonctionne (exemple de l\u2019EPLEFPA Bordeaux Blanquefort avec AHI 33).<\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">Le SRFD reconna\u00eet la n\u00e9cessit\u00e9 de cet \u00e9tat des lieux.<\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\"><b>4 &#8211; <u>N\u00e9cessit\u00e9 d\u2019une nouvelle r\u00e9union rapide<\/u><\/b><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">Enfin l\u2019\u00c9lan commun demande une nouvelle r\u00e9union rapide de la Commission r\u00e9gionale pour un \u00e9tat des lieux pr\u00e9cis de l\u2019avanc\u00e9e des groupes de travail dans les EPL\u00a0; ceci afin d\u2019apporter des correctifs si cela \u00e9tait n\u00e9cessaire.<\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">Pour l\u2019\u00c9lan commun les questions sont nombreuses\u00a0: tous les groupes de travail auront-ils \u00e9t\u00e9 constitu\u00e9s et r\u00e9unis dans tous les EPL ? &#8211; quelles consignes auront \u00e9t\u00e9 donn\u00e9es par la DRAAF pour la constitution de ces groupes de travail\u00a0? &#8211; sur quelle base y seront repr\u00e9sent\u00e9s les personnels ? &#8211; la note de service de 2024 et le protocole en vigueur ont-ils \u00e9t\u00e9 communiqu\u00e9s aux membres des groupes de travail ? &#8211; quel calendrier de travaux est pr\u00e9vu dans chaque EPL ? &#8211; quelles sont les probl\u00e9matiques identifi\u00e9es dans les diff\u00e9rentes r\u00e9unions ? &#8230;<\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"color: #000000\"><span style=\"font-family: Arial, sans-serif\"><span style=\"font-size: small\">Le SRFD se montre r\u00e9ticent \u00e0 acc\u00e9l\u00e9rer le calendrier et renvoie la prochaine r\u00e9union au mois d\u2019avril \u2026 une r\u00e9ponse probl\u00e9matique pour l\u2019\u00c9lan commun qui relancera la Directrice r\u00e9gionale d\u00e8s le mois de janvier.<\/span><\/span><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Commission r\u00e9gionale de suivi des conditions d\u2019emploi des personnels contractuels sur budget des CFA et CFPPA des EPLEFPA de Nouvelle Aquitaine 11 d\u00e9cembre 2024 Compte rendu La \u00ab\u00a0Commission r\u00e9gionale de suivi des conditions d\u2019emploi des personnels contractuels sur budget des CFA et CFPPA des EPLEFPA\u00a0\u00bb s\u2019est r\u00e9unit le 11 d\u00e9cembre dernier.
