dangereux (ex. : verglas, inondations).<\/span><\/li><\/ul><p class=\"whitespace-break-spaces\" dir=\"auto\" style=\"text-align: justify\"><span style=\"font-family: tahoma, arial, helvetica, Elle rel\u00e8ve d\u2019une <strong>impossibilit\u00e9 temporaire d\u2019assurer les cours en pr\u00e9sentiel<\/strong>, li\u00e9e \u00e0 des circonstances exceptionnelles.<\/span><\/p><p class=\"whitespace-break-spaces\" dir=\"auto\" style=\"text-align: justify\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif;color: #129447\"><strong> Pour le personnel \u00e9ducatif : une journ\u00e9e sans obligation de rattrapage.<\/strong><\/span><\/p><ul style=\"text-align: justify\"><li><span style=\"font-family: tahoma, arial, helvetica, sans-serif;color: #129447\"><strong>Pas de retenue sur salaire<\/strong> : La direction <strong>ne peut pas<\/strong> vous p\u00e9naliser financi\u00e8rement pour cette journ\u00e9e. Votre r\u00e9mun\u00e9ration doit \u00eatre maintenue int\u00e9gralement.<\/span><\/li><li><span style=\"font-family: tahoma, arial, helvetica, sans-serif;color: #129447\"><strong>Pas de rattrapage impos\u00e9<\/strong> : Aucun cours ne peut vous \u00eatre demand\u00e9 en pr\u00e9sentiel ou \u00e0 distance pour \u00ab compenser \u00bb cette journ\u00e9e. Les dispositifs de <strong>cours \u00e0 distance<\/strong>, mis en place de mani\u00e8re exceptionnelle pendant la crise sanitaire (COVID-19), <strong>ne s\u2019appliquent pas ici<\/strong> : ils relevaient d\u2019un cadre d\u00e9rogatoire sp\u00e9cifique, valid\u00e9 par le minist\u00e8re de l\u2019Agriculture.<\/span><\/li><li><span style=\"font-family: tahoma, arial, helvetica, sans-serif;color: #129447\"><strong>Pas d\u2019heures suppl\u00e9mentaires forc\u00e9es<\/strong> : Certaines directions invoquent un pr\u00e9tendu \u00ab <strong>manque de compl\u00e9tude de formation<\/strong> \u00bb pour justifier des rattrapages ou des heures suppl\u00e9mentaires. <strong>C\u2019est ill\u00e9gal<\/strong> :<\/span><ul><li><span style=\"font-family: tahoma, arial, helvetica, sans-serif;color: #129447\">Une direction peut <strong>\u00e9valuer<\/strong> un manque de compl\u00e9tude, mais <strong>ne peut pas<\/strong> vous imposer de rattraper vos heures ou d\u2019effectuer des heures suppl\u00e9mentaires <strong>sans votre accord \u00e9crit<\/strong>.<\/span><\/li><li><span style=\"font-family: tahoma, arial, helvetica, sans-serif;color: #129447\">En cas de refus de votre part, <strong>c\u2019est \u00e0 l\u2019employeur de trouver des solutions<\/strong> (remplacements r\u00e9mun\u00e9r\u00e9s, r\u00e9organisation du service), <strong>pas \u00e0 vous de subir une charge de travail suppl\u00e9mentaire non consentie<\/strong>.<\/span><\/li><\/ul><\/li><\/ul><p class=\"whitespace-break-spaces\" dir=\"auto\" style=\"text-align: justify\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif;color: #129447\"><strong> Pour le personnel non-\u00e9ducatif : exercer son droit de retrait si n\u00e9cessaire<\/strong>.<\/span><\/p><p class=\"whitespace-break-spaces\" dir=\"auto\" style=\"text-align: justify\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif;color: #129447\"> Si vous faites partie du personnel administratif, technique ou d\u2019encadrement, l\u2019\u00e9tablissement peut techniquement rester ouvert. Cependant :<\/span><\/p><ul style=\"text-align: justify\"><li><span style=\"font-family: tahoma, arial, helvetica, sans-serif;color: #129447\"><strong>Votre s\u00e9curit\u00e9 prime<\/strong> : Si les conditions d\u2019acc\u00e8s ou de travail sont dangereuses (routes impraticables, locaux non s\u00e9curis\u00e9s, etc.), vous pouvez <strong>exercer votre droit de retrait<\/strong> (cf. <a style=\"color: #129447\" href=\"https:\/\/www.legifrance.gouv.fr\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer external\">Article L. 4131-1 du Code du travail<\/a>).<\/span><ul><li><span style=\"font-family: tahoma, arial, helvetica, sans-serif;color: #129447\"><strong>Proc\u00e9dure<\/strong> : Informez en \u00e9crit la direction (mail ou courrier) en pr\u00e9cisant les <strong>risques objectifs<\/strong> pour votre sant\u00e9\/s\u00e9curit\u00e9. l\u2019arr\u00eat), le SNETAP-FSU a <strong>saisi le Chef du Service R\u00e9gional de la Formation et du D\u00e9veloppement (SRFD)<\/strong> pour rappeler aux Directions des \u00c9tablissements
